Petition to urge Hays County Commissioners’ Court to Appeal District Court Ruling

Whereas THK Properties, LLC (aka Nickolas Ramus) did install a non-compliant commercial on-site septic facility on his two acre residential property and had his permit revoked by Hays County Commissioners’ Court on April 17, 2007, and

Whereas Nickolas Ramus filed suit in District Court June 7, 2007, against Hays County claiming it lacked authority to enforce state public health and safety laws, and

Whereas a March 26, 2008 ruling in Hays County District Court attacks the principle that our counties have authority to enforce state laws, and

Whereas the rule of law has been placed in jeopardy for all Texas counties unless this flawed Hays County District Court ruling is overturned by the Third District Court of Appeals,

We, the undersigned do hereby urge and implore Hays County Commissioners’ Court to appeal this flawed District Court ruling so as to preserve county authority to enforce its public health and safety laws for the protection of Hays County citizens and all citizens throughout the state of Texas.
